These terms and conditions of sale (the « Terms ») govern all purchases made through the Those Times service (the « Service »), accessible at thosetimes.app and operated by ThoseTimes (« we »). They are effective as of 14 May 2026 and remain available on the Service at all times. By making a purchase, you (« you » or the « Customer ») acknowledge that you have read, understood and accepted these Terms in their entirety.
1. Purpose and description of the Service
The Service lets the Customer upload photographs, add descriptions to them, and generate an AI-powered animated video montage. The video is delivered as a downloadable MP4 file. The Service constitutes digital content not supplied on a tangible medium in the meaning of consumer-protection laws applicable to digital goods.
2. Customer account
Use of the Service requires creating an account with a valid email address. The Customer is solely responsible for keeping their credentials confidential and for all actions taken from their account.
3. Prices and payment
Prices are listed in euros, inclusive of all applicable taxes. Payment is processed exclusively by debit/credit card through our provider Stripe. We do not store any card data; only your Stripe customer identifier is retained to facilitate subsequent purchases.
The commercial offer is based on Moments — prepaid credits each corresponding to the generation of a film of a given length. Moments do not expire and are not redeemable for cash or convertible between different sizes.
4. Immediate performance and waiver of the right of withdrawal
Where consumer-protection law affords a withdrawal period for distance sales of digital content, the Customer expressly waives that right of withdrawal by requesting immediate performance of the Service. By ticking the dedicated checkbox at payment time, the Customer acknowledges that they:
- expressly request immediate performance of the Service;
- expressly waive their right of withdrawal once the corresponding Moment has been credited to their wallet;
- have read and accepted these Terms.
5. Refund policy
Given the digital nature of the Service and the waiver above, no refund is due for dissatisfaction with the artistic outcome of a generated video, the unpredictable behaviour of AI models, or any other reason of personal convenience.
On an exceptional and discretionary basis, on request sent to contact@thosetimes.app within fourteen (14) days of the purchase, a refund or equivalent credit may be granted in the following cases:
- persistent technical inability to deliver a generated video despite our reasonable efforts;
- double-charge or billing error caused by the payment provider;
- fraud on the payment instrument duly reported through the relevant banking channels.
6. Nature of AI-generated results
The Service relies on generative AI models whose outputs are inherently probabilistic and variable. The Customer expressly acknowledges that:
- delivered videos may include visual artifacts, distortions of faces, limbs, objects or backgrounds, and unexpected behaviour inherent to the underlying technology;
- no specific artistic outcome is guaranteed; the Service is provided « as is » with no commitment to any subjective expectation;
- these characteristics are included in the price and do not justify a refund request.
The Customer undertakes to upload only photographs they own or for which they have obtained all necessary rights from the persons depicted. In particular, the Customer agrees not to upload any content that infringes human dignity, depicts minors in problematic contexts, contains sexual or hateful material, or otherwise infringes any third-party rights.
7. Intellectual property
The Customer retains all rights in the photographs they upload. Subject to full payment, the Customer is granted a personal, worldwide, non-exclusive licence to use the generated video, including for private sharing. Any commercial exploitation requires our prior written consent.
The Those Times trademark, logos, website and underlying software remain our exclusive property.
8. Limitation of liability
Our liability cannot be engaged for indirect damages, including loss of opportunity, customers, image, or any moral prejudice. Our total contractual liability, for any cause, is capped at the amount actually paid by the Customer during the twelve (12) months preceding the triggering event.
9. Personal data
Processing of the Customer's personal data is described in our privacy policy. The Customer has the rights set out by applicable data-protection law and may exercise them at contact@thosetimes.app.
10. Suspension and termination
We reserve the right to suspend or terminate any account that breaches these Terms, in particular article 6 (prohibited content), or in case of payment fraud. The Customer may terminate their account at any time from the Settings page; deletion of data is then carried out according to our privacy policy.
11. Changes to the Terms
We may amend these Terms at any time. The version applicable to a purchase is the one in force on the day of that purchase. The accepted version is stored as evidence.
12. Governing law and jurisdiction
These Terms are governed by French law. Any dispute will be submitted to the courts having jurisdiction over the consumer Customer's place of residence. Consumers may also have free access to a consumer mediator for the out-of-court resolution of any dispute.
